Applicability & Acknowledgement
This Privacy Policy applies to Personal Data that Vivo Care collects from Users and Visitors. By continuing to use the Services, you agree to allow us to collect, store, and process your Personal Data as outlined in this privacy policy. If at any point you no longer agree to our collection, use, or disclosure of your Personal Data as described in this Privacy Policy, you should stop using the Services and delete any downloaded files from your device(s).
Summary
- We collect the following Personal Data from You: Your account details (e.g., name, email, role, licensure), support information (e.g., messages to support), device/usage information (e.g., IP address, device identifiers, cookies), location data derived from your IP address, precise location data if you allow it, and any other information you provide to us via forms, surveys, and other communications. For clarity, we do not access or use your device’s camera or microphone.
- We use the Personal Data we collect from You to provide and improve the Services, support Your account, and secure the Platform. We do not sell your Personal Data and we do not allow third parties to use your data for their own advertising or cross-context behavioral advertising.
- We share Personal Data only with service providers and partners who help us run the Services under contracts that limit their use of your data to our instructions.
- You can request access to or correction of your Personal Data by emailing support@vivocaresolutions.com. If you delete your account, we can deactivate your account but may be legally or contractually obligated to retain a copy of your data for a period of time.
Updates to this Policy
Please note that we occasionally update this Privacy Policy, and it is your responsibility to stay up to date with any amended versions. We will post revisions in the Platform and on our Website. All such changes will be effective immediately upon providing notice to you and will apply to all Personal Data that we maintain, use, and disclose. If you continue to use the Services and Remote Care Platform following such notice, you agree to the revised terms.
Account Deletion
You can request account deactivation by contacting support at support@vivocaresolutions.com. We may retain certain information as necessary to comply with law, resolve disputes, prevent fraud or abuse, comply with our contractual obligations to your organization, or enforce our rights.
Collection
“Personal Data” means any information that can be used on its own or with other information in combination to identify or contact one of our Users.
We collect the following Personal Data from Platform users:
- Demographic data, such as your name, email address, phone number, job title, role (i.e. physician, registered nurse, clinical staff, or other non-reimbursable staff), the state where you are located, and the state(s) where you are licensed (if applicable).
- Technical data, such as call recordings, activity data, and your IP address.
We collect the following Personal Data from Website visitors, subject to your device permissions and preferences: - Demographic data and contact information, such as your name, email address, and job title.
- Device and technical data, such as your IP address.
- Activity data, such as webpages and files accessed or downloaded on your device.
- Your approximate location derived from your IP address, or more precise location data if your device settings permit.
Use
Vivo Care processes your Personal Data based on legitimate business interests, the fulfillment of our Services to you, compliance with our legal obligations, and/or your consent. We only use or disclose your Personal Data when it is legally mandated or where it is necessary to fulfill those purposes described in this Privacy Policy. Where required by law, we will ask for your prior consent before disclosing your Personal Data to a third party.
More specifically, Vivo Care processes your Personal Data for the following legitimate business purposes:
- To provide the Services to you and your organization;
- To fulfill our obligations to you under our Terms of Use;
- To communicate with you about and manage your account;
- To respond to lawful requests from public and government authorities, and to comply with applicable state/federal law, including cooperation with judicial proceedings and court orders;
- To handle technical support and other requests from you;
- To enforce and ensure your compliance with our Terms of Use or the terms of any other applicable services agreement we have with you or your organization;
- To manage and improve our operations and the Platform, including the development of additional functionality;
- To evaluate the quality of service you receive, identify usage trends, and improve your user experience;
- To keep our Platform safe and secure;
- To send you information about changes to our Services, terms, conditions, and policies;
- To allow us to pursue available remedies or limit the damages that we may sustain; and
- To de-identify, anonymize, and/or aggregate your Personal Data. De-identified and anonymized data cannot be used to identify you and therefore no longer constitutes Personal Data and is no longer subject to this Privacy Policy.
Storage & Retention
We store your Personal Data on could servers based in the United States for as long as necessary to provide the Services, maintain your account, comply with our legal and contractual obligations, resolve disputes, and enforce our agreements. When Personal Data is no longer needed for these purposes and/or if you request deletion, we will delete or de-identify it in accordance with our contractual and legal obligations.
Disclosure
We do not share Personal Data with third parties for their independent advertising or marketing use. Any third party that receives Personal Data must have a legitimate need to support the Services and is required to protect Personal Data and use it only for the purposes we specify.
We may share your personal information with the following categories of individuals/entities for the purposes outlined:
- Business Partners and Vendors who help us provide the Services to you, improve the Services, and secure your Personal Data.
- Our Advisors who help us run our business, including without limitation our lawyers, auditors, accountants, and banks.
- Third‑Party service providers (for example, cloud hosting, customer support, security, and IT) solely to help operate, secure, and support the Services.
- Third Parties pursuant to business transfers in the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Vivo Care’s corporate entity, assets, or stock (including in connection with any bankruptcy or similar proceedings).
- Government and law enforcement authorities to (i) comply with legal processes or enforceable governmental requests, or as otherwise required by law; (ii) cooperate with third parties in investigating acts or omissions that violate this Privacy Policy or our Terms of Use; or (iii) bring legal action against someone who may be violating our Terms of Use or who may be causing intentional or unintentional injury or interference with the rights or property of Vivo Care or any third party, including you or other users of our Services. We will disclose only the minimum necessary information and, where legally permitted, we will attempt to notify you of such requests.
- Other Third Parties upon your direction or consent.
- To the extent possible, all third parties with whom we disclose your Personal Data are obligated to protect Personal Data and to use it only as instructed by Vivo Care. We may also disclose de‑identified information as described in this Privacy Policy and share Personal Data if required by law or to protect rights, safety, or the integrity of the Services. We do not sell Personal Data and do not share it for third‑party advertising.
We do not collect or use minors’ Personal Data
Vivo Care does not knowingly collect Personal Data from individuals under the age of 18 and storing, processing, or otherwise using Personal Data of individuals under 18 through the Services in strictly prohibited. If we discover Personal Data of anyone under 18 associated with your account, we may suspend or deactivate your account and take reasonable measures to promptly delete such data from our records. If you are aware of a user under the age of 18 accessing the Services, please contact us at support@vivocaresolutions.com.
Your rights
You may request access to, correction of, or deletion of your Personal Data by contacting support@vivocaresolutions.com. You may opt out of marketing emails at any time via the unsubscribe link or by contacting us. If you delete your account or request that we delete your Personal Data, we will remove it from active systems and will retain only what we must for legal, regulatory, fraud prevention, or security purposes and for backup integrity for a limited time.
Where the processing of your Personal Data by Vivo Care is based on consent, you have the right to withdraw that consent at any time. If you would like to withdraw your consent or exercise any of the above rights, please contact us at support@vivocaresolutions.com. You can withdraw permission for location collection at any time by disabling the Platform’s location permission in your device settings.
Security measures
We use a combination of reasonable physical, technical, and administrative security controls to: (i) maintain the security and integrity of your Personal Data; (ii) protect against any threats or hazards to the security or integrity of your Personal Data; and (iii) protect against unauthorized access to or use of such information in our possession or control that could result in substantial harm to you.
We recommend enabling Single Sign-On (SSO) to help protect your account from unauthorized access. SSO using SAML is supported.
While Vivo Care uses reasonable security controls, we cannot guarantee that such techniques will prevent unauthorized access to your Personal Data. Vivo care is unable to guarantee the security or integrity of Personal Data transmitted over the internet, and there is no guarantee that your Personal Data will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards. Accordingly, we do not and cannot ensure or warrant the security or integrity of any Personal data you transmit to us. You assume the risk that unauthorized entry or use, hardware or software failure, and other factors which may compromise the security of your Personal Data at any time.
Advertising, Marketing, and Tracking
Vivo Care may use your Personal Data to contact you with newsletters, marketing, or promotional materials and other information that may be of interest to you. Vivo Care does not sell your Personal Data and does not share your Personal Data with third parties for their own marketing purposes. You may opt out of receiving any marketing or advertisement materials from Vivo Care at any time by following the instructions included in any marketing communication you receive from us.
Cookies
We use cookies and other technologies to, among other things, better serve you with more tailored information, and to facilitate efficient and secure access to the Services. Cookies are small files that a web server sends to your computer or device when you visit a web application that uses cookies to keep track of your activity on that site. Cookies also exist within applications when a browser is needed to view or display certain content within the application. Cookies hold a small amount of data specific to a web application, which can later be used to help remember information you entered in the application (like your email or username), preferences selected, and movement within the application.
Our cookies do not, by themselves, contain Personal Data. Further, we do not combine the general information collected through cookies with any other Personal Data to identify you. However, we do use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your account. We do not sell Personal Data or use cookies to facilitate third-party targeted advertising.
We may also collect information using pixel tags, web beacons, clear GIFs, or other similar technologies. This information may be used in connection with website pages and HTML formatted email messages to, among other things, track the actions of Users and email recipients and compile statistics about usage and response rates.
Non-essential Cookies
Some cookies we use are essential for the Services to function properly. You can decline all non-essential cookies by configuring your browser settings or by responding to relevant prompts when accessing the Services. If you enable a do not track signal or otherwise configure your browsers to prevent us from collecting cookies, you will need to reenter your login information each time you visit the login page. You may also be unable to take advantage of some of the Services.
Third-Party Sites
Our Services may contain links to other sites that are not operated by Vivo Care. If you click a third-party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policy(ies) of every site you visit. Vivo Care has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services. This Privacy Policy does not apply to your use of or access to any third-party sites or services.
